ศาลอาญาคดีทุจริตและประพฤติมิชอบกลางพิพากษาจำคุก 2 ปี น.ส.พิรงรอง รามสูต คณะกรรมการกิจการกระจายเสียง กิจการโทรทัศน์ และกิจการโทรคมนาคมแห่งชาติ (กสทช.) ฐานเป็นเจ้าพนักงานปฎิบัติหรือละเว้นการปฎิบัติหน้าที่โดยมิชอบ ตามประมวลกฎหมายอาญามาตรา 157 กรณีที่บริษัท ทรู ดิจิทัล กรุ๊ป จำกัด ยื่นฟ้องกรณีที่ กสทช.มีหนังสือแจ้งผู้ได้รับใบอนุญาตประกอบกิจการกระจายเสียงและโทรทัศน์ ไม่ให้นำช่องรายการไปให้บริการบนแพลตฟอร์ม True ID เมื่อวันที่ 6 ก.พ. 2567 ที่ผ่านมา

ศาลเห็นว่าโจทก์เป็นผู้ให้บริการแอปพลิเคชัน True ID มาตั้งแต่ปี 2559 ประเภทผ่านอินเทอร์เน็ตสาธารณะ (Over-The-Top หรือ OTT) ในการประชุมคณะอนุกรรมการพิจารณาอนุญาตด้านกิจการโทรทัศน์ ครั้งที่ 3/2566 เมื่อ 16 ก.พ. 2566 จำเลยทำหน้าที่ประธาน ที่ประชุมนำวาระการตรวจสอบการแพร่เสียงแพร่ภาพผ่านกล่องทรูไอดี และแอปฯ True ID มาพิจารณา แต่ที่ประชุมไม่สามารถหาข้อสรุปได้ ประกอบกับปัจจุบันมีผู้ให้บริการ OTT เช่นเดียวกันจำนวนมาก ซึ่งไม่ได้เป็นผู้รับใบอนุญาตและกำกับดูแลจาก กสทช. และยังไม่ชัดเจนเกี่ยวกับข้อกฎหมาย

ต่อมาได้มีหนังสือไปยังผู้ประกอบกิจการกระจายเสียงหรือโทรทัศน์ 127 ราย โดยเลขานุการคณะอนุกรรมการฯ จัดทำบันทึกและร่างหนังสือของสำนักงาน กสทช. ตามระบบสารบัญ คนที่กลั่นกรองงานให้แก่รองเลขาธิการ กสทช. สอบถามเหตุผลและความจำเป็นว่าทำไมต้องระบุชื่อ True ID เป็นการเฉพาะ ได้รับแจ้งว่าจำเลยเป็นผู้สั่งการและเร่งรัดให้จัดทำ ต่อมาการประชุมครั้งที่ 4/2566 เมื่อวันที่ 2 มี.ค. 2566 จำเลยต่อว่าและตำหนิฝ่ายเลขานุการที่ไม่ได้ระบุหรือเจาะจงถึงการให้บริการ True ID และในรายงานการประชุมครั้งที่ 3/2566 ไม่ได้มีมติให้ทำหนังสือแจ้งถึงบริการ True ID แต่บันทึกรายงานการประชุมกลับระบุว่ามีมติรับรอง อันเป็นการทำเอกสารรายงานการประชุมอันเป็นเท็จ

นอกจากนี้ จำเลยยังได้กล่าวถ้อยคำในการประชุมครั้งที่ 3/2566 พยายามโน้มน้าวและรวบรัดการพิจารณา อีกทั้งก่อนจบการประชุมจำเลยใช้คำพูดว่า "ต้องเตรียมตัวจะ จะล้มยักษ์" และยอมรับว่าหมายถึงโจทก์ สื่อความหมายชัดเจนว่าประสงค์ให้กิจการของโจทก์ได้รับความเสียหาย เจตนามุ่งประสงค์กลั่นแกล้งโจทก์และใช้อำนาจไม่เป็นไปตามที่กฎหมายกำหนด ทำให้มีผู้ประกอบกิจการหลายรายได้ชะลอหรือขยายเวลาเข้าทำนิติกรรมกับโจทก์

น.ส.พิรงรองได้รับการประกันตัวด้วยวงเงิน 1.2 แสนบาท พร้อมเงื่อนไขห้ามเดินทางออกนอกประเทศ ทำให้ยังคงดำรงตำแหน่งกรรมการ กสทช. เช่นเดิม ถึงกระนั้นยังต้องต่อสู้อีกสองศาลที่เหลือ ได้แก่ ชั้นอุทธรณ์และชั้นฎีกา

วันนี้ (6 ก.พ.) ศาลอาญาคดีทุจริตและประพฤติมิชอบกลาง มีคำพิพากษาจำคุก 2 ปี น.ส.พิรงรอง รามสูต กรรมการกิจการกระจายเสียง กิจการโทรทัศน์ และกิจการโทรคมนาคมแห่งชาติ (กสทช.) ด้านกิจการโทรทัศน์ เป็นเวลา 2 ปี โดยไม่รอลงอาญา ในคดีที่ บริษัท ทรู ดิจิทัล กรุ๊ป จำกัด ฟ้องมาตรา 157 โดยกล่าวหาว่า น.ส.พิรงรอง มีเจตนากลั่นแกล้งทำให้ ทรู ดิจิทัล ไอดี บริษัทในกลุ่มทรู ดิจิทัล กรุ๊ปเสียหาย

สำหรับคดีดังกล่าว เนื่องจากการมีผู้บริโภคร้องเรียนมาที่สำนักงาน กสทช. เมื่อปี 2566 หลังจากได้พบว่าบนแพลตฟอร์มของแอปพลิเคชันทรู ไอดี (True ID) มีการโฆษณาแทรกในช่องรายการทีวีดิจิทัลของผู้ได้รับใบอนุญาตจาก กสทช. ซึ่งบริษัท ทรู ดิจิทัล กรุ๊ปฯ ในฐานะผู้ให้บริการแอปฯ ทรูไอดีได้นำสัญญาณมาถ่ายทอดในแพลตฟอร์มของตนเอง

ต่อมาคณะอนุกรรมการพิจารณาอนุญาตด้านกิจการโทรทัศน์ได้พิจารณาและเสนอความเห็นในเรื่องดังกล่าว และ สำนักงาน กสทช. ได้ออกหนังสือแจ้งไปยังผู้ประกอบการที่ได้รับใบอนุญาตประกอบกิจการโทรทัศน์ให้ตรวจสอบว่ามีการนำช่องรายการที่ได้รับอนุญาตไปออกอากาศผ่านโครงข่ายใดหรือนำไปแพร่ภาพในแพลตฟอร์มใดและให้ปฏิบัติตามประกาศ กสทช. และเงื่อนไขแนบท้ายใบอนุญาตที่เกี่ยวข้องโดยเคร่งครัด ซึ่งเป็นไปตามหลัก “มัสแครี่” (Must Carry) ที่มีโฆษณาแทรกไม่ได้ แม้หนังสือดังกล่าวไม่ได้ส่งตรงไปยังบริษัท ทรู ดิจิทัลฯ เนื่องจากบริษัทไม่ได้เป็นผู้ได้รับใบอนุญาตและไม่อยู่ภายใต้การกำกับดูแลของ กสทช. แต่บริษัทได้อ้างว่าการออกหนังสือดังกล่าวทำให้ตนเองเสียหาย จึงนำมาซึ่งการฟ้องร้องต่อการทำหน้าที่ของประธานอนุกรรมการชุดนี้ คือ น.ส.พิรงรอง กรรมการ กสทช.

ในคำร้องของบริษัททรูดิจิทัลฯ อ้างว่าหนังสือดังกล่าวเป็นเหตุที่ทำให้ตนเองได้รับความเสียหายเนื่องจากผู้รับใบอนุญาตประเภทช่องรายการโทรทัศน์ อาจทำการระงับการเผยแพร่รายการต่าง ๆ ผ่านทางแพลตฟอร์มของตน ในคำร้องได้อ้างว่าทางสำนักงาน กสทช. ยังไม่มีระเบียบเฉพาะในการกำกับดูแลกิจการ OTT (Over-The-Top หรือการให้บริการสตรีมเนื้อหาผ่านโครงข่ายอินเทอร์เน็ต)

อย่างไรก็ตาม น.ส.พิรงรอง ยืนยันว่า การออกหนังสือของสำนักงาน กสทช. เป็นการทำตามหน้าที่ในการคุ้มครองผู้บริโภคที่ได้รับผลกระทบจากการแทรกโฆษณาในบนแพลตฟอร์มทรูไอดีในการรับชมเนื้อหาตามประกาศมัสต์ แครี่ และดูแลลิขสิทธิ์เนื้อหาของผู้ให้บริการโทรทัศน์ดิจิทัล เพื่อให้เกิดการแข่งขันที่เสรีและเป็นธรรม ซึ่งการตรวจสอบของสำนักงาน กสทช. จนนำไปสู่การออกหนังสือดังกล่าวมาจากการร้องเรียนของผู้บริโภคที่ได้รับผลกระทบจากการแทรกโฆษณาบนกล่องทรูไอดี ทั้งนี้ ไม่ได้มีการเลือกปฏิบัติต่อผู้ประกอบกิจการรายหนึ่งรายใดเป็นพิเศษ

เป็นที่สังเกตได้ว่า หนังสือดังกล่าวที่ออกโดยสำนักงาน กสทช. มิใช่คำสั่งทางปกครอง จึงไม่มีผลบังคับใช้ตามกฏหมาย อย่างไรก็ตาม เมื่อผู้ได้รับใบอนุญาตได้รับหนังสือข้างต้นและจะปฏิบัติตามประกาศ กสทช. ในประเด็นมัสแครี่ อย่างเคร่งครัดหรือไม่ ก็ยังไม่มีบทลงโทษตามกฎหมาย และผู้ได้รับใบอนุญาตมีสิทธิที่จะพิจารณาตามความเหมาะสมต่อรายการที่อยู่ภายใต้การประกอบการของตน

ก่อนหน้านี้ ในเดือน เม.ย. 2567 ศาลมีคำสั่งประทับฟ้องบริษัททรูดิจิทัลฯ ได้ยื่นคำร้องขอให้ศาลสั่งให้ น.ส.พิรงรอง ยุติการปฏิบัติหน้าที่กรรมการ กสทช. และประธานอนุกรรมการพิจารณาอนุญาตด้านกิจการโทรทัศน์ไว้ชั่วคราว จนกว่าศาลจะมีคำพิพากษาในคดีนี้

แต่ต่อมาในเดือน พ.ค. 2567 ศาลยกคำร้องดังกล่าว โดยพิจารณาว่าจำเลยไม่มีพฤติการณ์ที่แสดงให้เห็นว่าเป็นปฏิปักษ์ ขัดขวาง หรือกลั่นแกล้งการประกอบธุรกิจของโจทก์ตามที่กล่าวอ้าง อย่างไรก็ตาม หาก น.ส.พิรงรอง ถูกตัดสินว่ามีความผิดและไม่ได้รับสิทธิให้ประกันตัวระหว่างรอการอนุมัติการอุทธรณ์ จะต้องสิ้นสภาพการเป็นกรรมการ กสทช. ทันที

ทั้งนี้ ผู้ที่กระทำความผิดตามประมวลกฎหมายอาญามาตรา 157 มีโทษคุกตั้งแต่ 1 – 10 ปี หรือปรับตั้งแต่ 2,000 บาทถึง 20,000 บาท หรือทั้งจำทั้งปรับ ส่วนคุณสมบัติของ กสทช. ตามพระราชบัญญัติองค์กรจัดสรรคลื่นความถี่และกำกับการประกอบกิจการวิทยุกระจายเสียง วิทยุโทรทัศน์ และกิจการโทรคมนาคม พ.ศ. 2553 มาตรา 7 (6) และ (7) กำหนดลักษณะต้องห้ามของกรรมการ กสทช. ว่า เป็นบุคคลที่ต้องคำพิพากษาให้จำคุกและถูกคุมขังอยู่โดยหมายของศาล หรือ เคยได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่ในความผิดอันได้กระทำโดยประมาทหรือความผิดลหุโทษ

7 ปี สิ้นเชลยศึกชาวไทย “พันเอกชัยชาญ หาญนาวี” วีรบุรุษทหารรบพิเศษไทย ในสงครามเวียดนาม ที่อเมริกายกย่องเชิดชู

📅 ย้อนไปเมื่อ 7 ปี ที่ผ่านมา วันที่ 4 กุมภาพันธ์ 2561 ถือเป็นวันที่ประเทศไทย สูญเสียบุคคลสำคัญคนหนึ่ง ที่มีประวัติอันน่าจดจำ และเป็นที่เคารพในหมู่ทหารอเมริกัน ผู้ชายคนนั้นคือ “พันเอกชัยชาญ หาญนาวี” ทหารรบพิเศษไทย ที่ถูกจับเป็นเชลยศึกในสงครามเวียดนาม นานถึง 9 ปี 4 เดือน 8 วัน และได้รับการเชิดชูเกียรติ จากรัฐบาลสหรัฐอเมริกา ด้วยเหรียญกล้าหาญ Silver Star และ Legion of Merit 🏅

แม้ว่าหลายคนในไทย อาจไม่คุ้นชื่อของพันเอกชัยชาญ แต่สำหรับทหารอเมริกันในยุคนั้น ชัยชาญคือวีรบุรุษที่ช่วยชีวิตเชลยศึกสหรัฐฯ มากมาย แม้ต้องเผชิญกับการทรมาน อันโหดร้ายในเรือนจำ "ฮานอยฮิลตัน" (Hỏa Lò Prison) ในกรุงฮานอย ประเทศเวียดนามเหนือ 🇹🇭🇺🇸

👦 จากชาวอยุธยา สู่ทหารรบพิเศษไทย 🔴
พันเอกชัยชาญ หาญนาวี เกิดที่จังหวัดพระนครศรีอยุธยา และเข้ารับราชการทหาร ในหน่วยกองรบพิเศษที่ 1 ค่ายวชิราลงกรณ์ จังหวัดลพบุรี ซึ่งเป็นหน่วยที่ฝึกอบรมทหารไทย ให้สามารถปฏิบัติภารกิจพิเศษ ร่วมกับกองทัพสหรัฐฯ

ด้วยทักษะที่โดดเด่น ชัยชาญถูกส่งไปปฏิบัติภารกิจ ที่ประเทศลาว ในช่วงสงครามเวียดนาม ทำหน้าที่เป็นพลวิทยุ ให้กับหน่วยรบพิเศษไทย-อเมริกัน

✈️ ภารกิจที่ผิดพลาด นำไปสู่การเป็นเชลยศึก
📅 วันที่ 21 พฤษภาคม 2508 เป็นวันหยุด ที่เปลี่ยนแปลงชีวิตของพันเอกชัยชาญ ไปตลอดกาล เมื่อถูกชวนขึ้นเครื่องบินของ Air America (สายการบินลับของ CIA) เพื่อไปทำหน้าที่เป็น Spotter หรือผู้ระบุตำแหน่งข้าศึก

ขณะที่เครื่องบินกำลังบินจากเชียงลม แขวงไชยะบุรี ประเทศลาว เพื่อส่งเสบียงให้ฐานปฏิบัติการ เกิดเหตุการณ์ไม่คาดฝัน เครื่องถูกยิงตกกลางป่า ทหารอมริกันเสียชีวิตทั้งหมดทันที พันเอกชัยชาญและนักบินรอดชีวิต และพยายามหลบหนี แต่สุดท้ายถูกจับกุม โดยกองทัพเวียดนามเหนือ

ชัยชาญถูกส่งไปยังค่ายเชลย ที่มีชื่อเสียงจากภาพยนตร์เรื่อง "แหกค่ายนรกเดียนเบียนฟู" ที่ซึ่งการทรมานนักโทษ ถือเป็นเรื่องปกติ...

🏚️ จากเดียนเบียนฟู สู่ฮานอยฮิลตัน ⚠️
หลังจากถูกขังอยู่ที่เดียนเบียนฟู นานเกือบ 3 ปี ชัยชาญถูกย้ายไปยังเรือนจำ "ฮานอยฮิลตัน" (Hỏa Lò Prison) ซึ่งเป็นคุกที่เลื่องชื่อ ในหมู่เชลยศึกอเมริกัน

📌 ที่นี่ชัยชาญถูกขังเดี่ยว 5 ปี ถูกซ้อมทรมานเป็นประจำ ถูกมัดติดขื่อไม้ และต้องนอนเกลือกกลั้ว อยู่กับอุจจาระ และปัสสาวะของตัวเอง ได้รับอนุญาตให้อาบน้ำ เพียงเดือนละครั้ง 😞

เป็นรหัสลับที่เชลยศึกอเมริกัน พัฒนาเพื่อใช้สื่อสารกัน โดยการเคาะกำแพง ตามจังหวะที่กำหนด เพื่อแทนตัวอักษร คล้ายกับรหัสมอร์ส หรือรหัสแตะ สามารถส่งได้หลายวิธี และในสภาพแวดล้อม ที่ยากลำบาก

📅 หลังจากถูกกักขัง ยาวนานกว่า 9 ปี พันเอกชัยชาญได้รับการปล่อยตัว ในปี 2517 จากการเจรจาระหว่างไทย-สหรัฐฯ และเวียดนามเหนือ

💔 แต่เมื่อกลับมาถึงมาตุภูมิ ชัยชาญพบว่า ภรรยาแต่งงานใหม่ไปแล้ว ซึ่งตอนกลับมาได้รับพระราชทาน ยศชั้นนายพันแล้ว เพราะกองทัพไทยคิดว่า คงหายสาบสูญไป ในสงครามแล้ว แต่เมื่อยังมีชีวิตอยู่ ก็ได้กลับมารับราชการเหมือนเดิม ไม่มีใครกล้าถอดยศพระราชทาน

แม้ว่าชีวิตส่วนตัวจะพังพินาศ แต่เกียรติยศของชัยชาญ กลับได้รับการยกย่อง จากกองทัพสหรัฐฯ สหรัฐอเมริกามอบเหรียญกล้าหาญ "Silver Star" และ "Legion of Merit" ให้ชาญชัย พร้อมจัดพิธีเชิดชูเกียรติที่ Pentagon

LONDON, Jan 29 (Reuters) - London bullion market players are racing to borrow gold from central banks, which store bullion in London, following a surge in gold deliveries to the United States on speculation of potential import tariffs there, two sources familiar with the matter said.
The minimum waiting time to load gold out of the Bank of England, which stores gold for central banks, has reached four weeks, one of the sources said. In normal times, the release time is a few days or a week.

U.S. President Donald Trump has not mentioned precious metals in his tariff plans, but the risk has been enough to boost gold deliveries to New York as part of the market sought to hedge its positions on the U.S. COMEX (CME.O), opens new tab exchange and part sought to benefit from a jump in the price premium of COMEX futures over London spot prices .
London is home to the world's largest over-the-counter gold trading hub, where market players trade directly with each other rather than via an exchange.

"The key with the BoE is that they are not a commercial vault so not prepared to handle the onslaught of gold borrowing banks are requesting from the central banks," said Robert Gottlieb, an industry expert and former head of precious metals at Koch Supply and Trading.
The size of so-called Loco London free float, the amount of gold readily available to the London OTC market stored in London, has fallen after the jump in supplies to New York.

Over the last two months, 12.2 million troy ounces of gold were delivered to COMEX-approved warehouses , raising stocks there by 70% to 29.8 million ounces, the highest since August 2022.

Reports of the flow of gold to New York attracted the attention of the British parliament's Treasury Committee, one of whose members asked BoE Governor Andrew Bailey on Wednesday whether he saw any risks in this development.

"We are not in the gold standard anymore, it doesn't have significance for policy in that sense," Bailey replied, referring to an extinct monetary system where gold backed the value of a currency.
However, London remained a major gold market, and "if you want to be involved in that market and you want to trade and use your gold, you really need to have it in London," Bailey added.

Deliveries to the U.S. left less free-float metal in London vaults, the metal that is not owned by central banks or holdings of physically-backed gold exchange-traded funds. This in turn boosted demand from players in London who are ready to lease their gold and make it available to the OTC market.

Liquidity challenges in other large trading hubs are less pronounced than in London but are being felt globally, said Alexander Zumpfe, a precious metals trader at Heraeus Metals.

"The logistical complexities of moving large quantities of gold, particularly from Europe to the U.S., are amplifying these stresses. Asia has also seen some knock-on effects, particularly in markets like Singapore and Hong Kong," Zumpfe added.

“Stew” vs. “Soup”: Simmer On The Differences Between Them

Throw a bunch of ingredients in a pot, add liquid, heat it up, and what do you get? That’s actually a harder question to answer than you might think. Dishes made in this way can be labeled soup, stew, broth, bisque, or chowder.

When it comes to food, people have strong preferences not only about taste but also about what things are called. In this article, we’ll get to the bottom of the bowl by explaining when and why a dish may be called a soup vs. a stew and breaking down the same distinctions between soup and broth, bisque, and chowder.

Generally speaking, a dish is called soup when it’s primarily liquid-based. Stews are thicker and chunkier. But an especially thick and chunky soup could be called a stew. What is the difference between soup vs. stew?

The main characteristic of the dish we call soup is that it’s primarily liquid-based. Regardless of what other ingredients it has in it (meat, fish, vegetables, whatever), they’re either submerged (or mostly submerged) in the liquid or are blended as part of it. The first example constitutes what’s often called a brothy soup. The second example is what we’d usually call a creamy soup (creamy as in texture—it may or may not have cream in it). But there are a lot of variations. And this is where the plot thickens.

The dish we call stew may start the same way as a soup, and can include many of the same ingredients used in soup (meat, fish, vegetables, whatever). Stews are cooked by simmering or slow boiling, known as stewing. Obviously, the descriptions of soup and stew sound very similar.

The popular distinction between these two foods is how “liquidy” or how thick they are: a dish called soup typically has more liquid in it than a stew does. Stews are generally thicker than soups, being made up primarily of larger, solid chunks of ingredients. In other words, stews are thicker and chunkier—and always have solid ingredients.

Generally speaking, if there is so much liquid that the ingredients are fully submerged, it’s a soup. If the chunks dominate the dish, it’s a stew.

Of course, a dish labeled as soup can be pretty thick and chunky. And, sometimes, cooking adjustments can turn one into another. A soup could become a stew if cooked long enough that most of the liquid boils off or is absorbed by the ingredients. Or you could add more liquid to a stew to make it soupier. The point at which a soup becomes a stew (or vice versa) can be endlessly debated.

That’s because there is no exact measurement or technical rule separating the two. In many cases, both words could be reasonably applied to the same dish. The difference is often simply a matter of preference or opinion.

broth vs. soup

The essential ingredient in many soups is broth (or stock). Broth is traditionally made by boiling or simmering water with ingredients that will give it flavor, such as meat, fish, or vegetables (and often a combination of things).

The primary flavor of a broth is often specified: chicken broth, beef broth, vegetable broth, etc. For example, chicken noodle soup is traditionally made with chicken and noodles in a chicken broth.

But can broth be considered soup by itself? Yes, in fact, when broth is eaten—even without any added ingredients—it is typically considered soup. For example, a type of clear soup known as a consommé can be considered a broth if it is used as a base for the addition of other ingredients but a soup if it is eaten by itself.

bisque vs. soup

A bisque is a type of thick soup that uses cream as a main ingredient. The term bisque is typically applied to soups that have some kind of shellfish or vegetable as the key ingredient. Classic examples of bisques include lobster bisque, shrimp bisque, crab bisque, tomato bisque, and potato bisque.

While most people agree that bisque is a type of soup, some may distinguish creamy bisques from non-creamy soups in the same way that others distinguish liquid-forward soups from chunky stews.

chowder vs. soup

Chowder is a type of thick soup whose most traditional and well-known forms contain clams, fish, or other seafood, often in a creamy, milk-based broth and also featuring potatoes, onions, tomatoes, or other vegetables. Different types of clam chowder are especially popular in the Northeast region of the US. Other examples of chowder include fish chowder, corn chowder, and potato chowder.

Most chowders are usually considered a type of soup, but their creamy thickness can also result in them being labeled as a stew.

Some people may take the hairsplitting even further and argue that chowder is its own unique thing in the same way that people distinguish soups from stews.
